DECISION OF THE BOARD:  September 27, 2013

 

 

1.                           Board File No. 3806-12-R is an application for termination of bargaining rights filed under the Labour Relations Act, 1995, S.O. 1995, c.1, as amended (the “Act”).  The applicant has applied to the Board under section 63 of the Act for a declaration that the responding party, United Brotherhood of Retail, Food, Industrial and Service Trades International Union (the “Union”) no longer represents the employees in the bargaining unit for which it is the bargaining agent.  Board File Nos. 0007-13-U and 0366-13-U are related unfair labour practice applications.

 

2.                           At the commencement of the hearing in this matter held on September 23, 2013, the parties advised that they had been able to reach agreement on the outstanding preliminary issues relating to timeliness and particulars.  This decision therefore confirms that the applicants in Board File No. 3806-12-R and Window City Industries Inc. have withdrawn their objection to any particulars provided by the Union up to and including June 10, 2013 and that the Union has withdrawn the particulars set out in its September 19, 2013 letter and has agreed not to raise any new allegations.  Having regard to the parties’ agreement, the Union is directed to provide the requested recordings to the other parties by October 7, 2013 and to provide the other parties with the particulars requested by the other parties by October 11, 2013.
