WAIVER, RELEASE AND CONSENT - I affirm that I am participating voluntarily as a player, official or spectator in the 2024 Conyers CIGFC Mixed 11s (the “Activities”) held by the Cayman Islands Gaelic Football Club (the "Club") at the Camana Bay Sports Complex, Grand Cayman. I represent, covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under or through me, as follows: (1) I acknowledge that participating in the Activities involves certain risks (some of which I may not fully appreciate) and that injuries, death, property damage or other harm could occur to me or others. (2) I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from my participation in the Activities. These risks include, but are not limited to, the possibility of accident or illness and injury arising out of participation in the physical activity involved with the Activities. (3) The Club strongly recommends that each participant have an annual physical examination and carry personal health insurance as required by Cayman Islands laws. (4) I waive all claims against the Club, its directors, trustees, affiliates, employees, officers, agents, or insurers (the “Released Parties”) for any injuries, damages, losses or claims, whether known or unknown, which arise during or result from my participation in the Activities. (5) I release and forever discharge the Released Parties from all such claims. The parties agree that this Waiver and Release does not waive or release any rights I may have under Cayman Islands laws governing workers’compensation. I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to attorneys’ fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against any of the Released Parties to recover any losses, liabilities, damages, costs or expenses which arise during or result from my participation in the Activities. (6) I agree to give the Club, its assigns, licensees and representatives the irrevocable right to use my name, photograph, image, audio recording, video recording and likeness (“Images”) in all forms and manner including but not limited to publication on websites, broadcasts and any other publications as released to or by the Club. (7) I agree that the Club cannot control unauthorized use of Images by persons not associated with the Club once Images have been published. (8) I agree to waive forever any right to inspect or approve any publication of Images by the Club. (9) I consent to the Club using the information I've provided to administer and conduct Club activities, including to contact me about Club events and fundraising activities. (10) I acknowledge that the Club newsletter, Facebook page, Instagram page, Twitter page, website and other social media platform (including WhatsApp or other messaging apps) may contain links to other websites and the Club is not responsible for the privacy practices or the content of external websites. (11) I acknowledge that other members of the Club may communicate with me via social media platforms as a result of my participation in the Activities and the Club is not responsible for and the Club cannot control communications between Club members which is not expressly authorised by or on behalf of the Club. (12) I agree that I will use any social media platforms in a responsible manner. (13) I agree that I will not: (i) use any social media platform for any activities or post or transmit to or via social media platforms any information or materials which breach any laws or regulations, infringe a third party’s rights, or are contrary to any relevant standards or codes; (ii) use any social media platform in a way or post to or transmit to or via any social media platform any material which interferes with other users or defames, harasses, threatens, menaces, offends or restricts any person or which inhibits any other user from using or enjoying that social media platform; (iii) make any fraudulent or speculative enquiries, bookings, reservations or requests using any social media platform; (iv) post, or transmit via any social media platform, any obscene, indecent, inflammatory or pornographic material or material that could give rise to civil or criminal proceedings; (v) tamper with, hinder the operation of or make unauthorised modifications to any social media platform; (vi) knowingly transmit any virus or other disabling feature to any social media playform; and (vii) attempt any of the above acts or permit another person to do any of the above acts. *
