Acceptance of the terms of use

This service makes it possible to file certain pleadings digitally with the office of the Court of Québec or Superior Court.

In the “Automobile and driver’s licence” section, the service enables users, after completing an online form, to digitally file an application for a restricted licence, an application for release from seizure for a vehicle, or an application to lift suspension of a driver’s licence or the right to obtain one with the office of the Court of Québec. It also enables the filing of documents that accompany an online application, if applicable.

In the “Non-contentious proceeding” section, the service allows for the digital filing of a pleading, exhibit or other document with the office of the Superior Court for non-contentious applications in accordance with the inclusions and exclusions listed on the “Information about filings in non-contentious proceedings” page.

Before using the Lexius digital filing service, the user must read and accept the terms of use for filing pleadings, exhibits and other documents and paying judicial fees online.

For the “Non-contentious proceeding” section, the provisions of the Regulation to establish a pilot project relating to digital transformation of the administration of justice take precedence over the terms of use in the event of a discrepancy.

1. Using the Lexius digital filing service

1.1 Service

The Ministère de la Justice (MJQ) makes the Lexius digital filing service available to users at all times subject to situations beyond its control and the exceptions set out in these terms of use.

The MJQ nevertheless reserves the right to restrict access to the Lexius digital filing service for the purpose of conducting technological infrastructure work. A notice will be posted on the Homepage to inform the user that such work is taking place.

For an optimal experience with the Lexius digital filing service, we recommend using one of the following browsers: Google Chrome or Microsoft Edge. We also recommend that users use the latest version of these browsers and make sure their operating system and web browser have the necessary updates and settings.

1.2 Timing of filing

Applications in the Automobile and driver’s licence section are processed on a priority basis during Court of Québec office hours within 24 hours (on business days) following their transmission, taking holidays into account.

Filings in the Non-contentious proceeding section are processed during Superior Court office hours within 24 to 48 hours (on business days) after they are sent, taking holidays into account. A filing can be identified as urgent if it relates to an application that is deemed urgent by law or by a court instruction.

Documents will be processed in accordance with Court of Québec and Superior Court laws and regulations.

An application filed through the Lexius digital filing service outside office hours is deemed filed at the time when the court office next opens.

The time zone indicated for the receipt of the digitally filed document is Eastern Time.

For example, if a user files a document for receipt by the office of the Superior Court at the Havre-Aubert courthouse in Îles-de-la-Madeleine, although the courthouse is in the Atlantic Time Zone (UTC-4), the time of receipt recorded on the document will be in Eastern Standard Time (UTC-5) and not the local time at the courthouse.

2. Access to the service’s “Non-contentious proceeding” section

2.1 Who can use the Lexius digital filing service

To file a pleading, exhibit or any other document related to a non-contentious application, Lexius digital filing service users must identify themselves with a permanent code.

Only lawyers, notaries and court bailiffs can have a permanent code, and this code is required in order to use the Lexius digital filing service.

The Lexius digital filing service can also be used to file the recommendations of the Curateur public du Québec, but only if they are filed by the Curateur public du Québec’s lawyer or notary.

2.2 Filing in an existing court record file

Filings in an existing court record file are reserved solely for digital court record files opened after the filing of a non-contentious proceeding as of the date when the Lexius digital filing service for non-contentious proceedings became operational.

3. Permitted content use

3.1 Intellectual property rights

The user allows the MJQ and the Superior Court and Court of Québec offices to make copies of the documents filed electronically through the Lexius digital filing service and disclose them to the public via telecommunications for justice administration purposes.

This authorization is granted with no territorial or time limit.

The user must make sure to hold the necessary rights, including copyrights, for the filed documents. The user is solely responsible for the documents filed using the Lexius digital filing service.

3.2 Privacy policy

The MJQ is committed to protecting users’ privacy and personal information. We have taken important measures to safeguard personal information provided through the Lexius digital filing service.

The handling of personal information by a public body such as the MJQ is governed by the Act respecting Access to documents held by public bodies and the Protection of personal information (CQLR, chapter A-2.1) (AIA).

Personal information means any identifying information concerning a natural person.

Personal information contained in public documents is not subject to the rules protecting personal information set out in the AIA.

3.2.1 Collection

The MJQ only collects the information it needs to perform its duties in the administration of justice.

3.2.2 Use

Personal information collected by a public body is used only for the purposes for which it was collected, subject to the exceptions set out in the AIA.

3.2.3 Disclosure

The confidential personal information collected is only disclosed to a third party with the consent of the person concerned or in accordance with the exceptions set out in the AIA.

3.2.4 Storage

The MJQ destroys personal information it has collected or used once its purpose has been fulfilled, subject to the Archives Act (CQLR, chapter A-21.1).

The information of the party identified in the filing form and the documents sent will be stored in accordance with the Archives Act.

3.3 Documents

3.3.1 Document format and size

Pleadings may only be filed as PDF files. Exhibits and supporting documents may be filed as PDF, PNG, GIF or JPEG files. Attachment file sizes must not exceed 100 MB for PDFs and 10 MB for JPEG, PNG and GIF files.

Multiple documents cannot be batched as one file. For example, users cannot file an originating application together with the exhibits or other pleadings or documents as one single file. However, exhibits can be filed with the same.

3.3.2 Precedence of the document

For matters covered by the “Non-contentious proceeding” section, If there is a discrepancy between the information in the filing form and the information in the document, the information in the document shall take precedence.

3.4 Limitation of liability

By using the Lexius digital filing service, users acknowledge that the MJQ is not liable for any costs, losses or damages they may incur:

a) because they did not comply with these terms of use; or

b) because they did not comply with the laws or regulations in effect in Québec.

3.5 Governing law

Use of the Lexius digital filing service is governed by the laws applicable in Québec. Any dispute arising from these terms of use shall be subject to the exclusive jurisdiction of the courts of Québec.

4. Payment of judicial fees and tariffs

4.1 Tariff of judicial fees

Applicable judicial fees are determined by the Tariff of judicial fees in civil matters (CQLR, chapter T-16, r. 10) in effect.

4.2 Payment of judicial fees

Users will be redirected to a secure platform to pay any judicial fees owing. No banking information is collected by the MJQ, the Superior Court or the Court of Québec.

Where applicable, judicial fees can be paid online at the time of filing or later using an invoice number sent by the court office. Payments can only be made with Visa, MasterCard or American Express.

5. Changes and updates

The Ministère de la Justice (MJQ) reserves the right to change or update these terms of use at any time and from time to time.

6. Acceptance of the terms of use

The user acknowledges and agrees with the following statements:

  • By accessing the website of the Lexius digital filing service and by clicking on “I accept the terms of use,” the user acknowledges having read and accepted the terms of use.
  • The MJQ reserves the right to change the terms of use at any time with no prior notice to users of the Lexius digital filing service. The user understands that they are solely responsible for reviewing the terms of use periodically.
  • By continuing to access the Lexius digital filing service and clicking on “I accept the terms of use,” the user acknowledges being aware of and consenting to any changes to the terms of use.
