Judge tosses gun case over Toronto police delays ‘bordering on negligent’

Toronto police simply did not provide evidence that should have been available since an April 2021 arrest, pushing the trial past a Supreme Court-imposed limit for allowable delay.

Toronto police’s slow pace at disclosing evidence in a firearms case was “bordering on negligent,” a judge said, tossing all charges due to delay.

Richard MacMillan had been arrested in April 2021 after allegedly pointing a gun at another man walking his dog during an early morning altercation. Police also executed a search warrant on his home. He was subsequently charged with eight firearm-related offences, including concealing a firearm and pointing a firearm without a lawful excuse.
