Morse Obtains Preliminary Injunction on Behalf of Client KPM Analytics

Morse Litigators Scott Magee and Paige Zacharakis recently obtained a significant preliminary injunction in Massachusetts Federal Court on behalf of our client KPM Analytics North America Corporation after expedited discovery related to its manufacturing, sale and servicing of near infrared analyzers. Scott and Paige brought claims on behalf of KPM against two competitors and several former employees, alleging misappropriation of trade secrets, unfair and deceptive trade practices, breach of the duty of loyalty and breach of confidentiality agreements signed by the former employees. The Court found a reasonable likelihood that KPM would succeed on those claims and enjoined the two competitors from selling certain goods and services to KPM’s customers. The Court further prohibited the defendants from using or disclosing KPM’s trade secrets and confidential information.
