Project summary

Terrapure Environmental has been granted approval under the Environmental Assessment Act to expand the Stoney Creek Regional Facility landfill by 3.68 million cubic metres.

The purpose of the project is to take advantage of the economic opportunity identified in a 2017 business case analysis. The increased capacity will allow Terrapure to continue disposing of solid, non-hazardous industrial, commercial and institutional (IC&I) materials for approximately 10-15 years.

The Stoney Creek Regional Facility landfill:

  • is located on a 75-hectare parcel of land at the northwest corner of Mud Street and Upper Centennial Parkway (Highway 20) in the community of Upper Stoney Creek
  • first received approval under the Environmental Assessment Act in 1996
  • was originally named the Taro East Landfill and owned by the former industrial division of Newalta Corporation, which was acquired by Terrapure Environmental in March 2015
  • is currently permitted to receive 750,000 tonnes of residual material and industrial soils or “fill” annually
  • has a total permitted capacity of 6.5 million cubic metres

On January 11, 2019, Terrapure Environmental submitted a final environmental assessment (EA) under the Environmental Assessment Act.

After taking the environmental assessment, comments received and environmental protection measures into consideration, the Minister decided to approve the undertaking, subject to conditions, on August 29, 2019.

An invitation to comment on the environmental assessment for the proposed Terrapure Stoney Creek Regional Facility expansion.

An environmental assessment (EA) has been submitted to the Ministry of the Environment, Conservation and Parks by Terrapure Environmental for the undertaking, Stoney Creek Regional Facility Expansion, in the City of Hamilton. The Ministry of the Environment, Conservation and Parks has prepared a ministry review (review) of the EA for public and agency comment. The review of the EA does not make a decision about the EA. That decision is made by the Minister of the Environment, Conservation and Parks after the comment period is over and consideration of all submissions.

You can submit comments on the undertaking, the environmental assessment, and the ministry review. You may also request a hearing by the Environmental Review Tribunal. If you request a hearing you must state in your submission, whether you are requesting a hearing on the whole application or on only specified matters related to the application.

The amendments require Terrapure Environmental to examine the feasibility and viability of an on-site diversion program as part of the environmental assessment process.

As provided for by subsection 6(4) of the Environmental Assessment Act, the amended Terms of Reference, as submitted for approval to the Ministry of the Environment and Climate Change on May 9, 2017, is hereby approved with the following amendments:

  1. Subsection 2.1.1, the paragraph, shall be amended to read:
    The material accepted at the SCRF comes from a variety of customers and businesses that divert at their own operations and have implemented their own diversion and recovery system. Terrapure has Standard Operating Procedures (SOP) that addresses the screening and verification of material that is received on-site to ensure the materials received on-site match the Generator’s Waste Profile, and that the Generator of the material has made the determination that the material cannot reasonably be diverted. Diversion at the source of the generated residual material from generators and customers considers both the economic viability of diversion as well as ensuring that there is a viable end market for the diverted material. Although there is minimal waste material received at the SCRF that has the potential to be reasonably diverted or recycled, Terrapure will examine and evaluate the feasibility and viability of implementing an onsite diversion program as part of the environmental assessment process. This will include the consideration and assessment of a reasonable number of ways in which to divert the types of waste materials received at site. The assessment of an onsite diversion program will be carried out in accordance with best management practices, in consideration of new and emerging technologies, and in recognition of the goals and expectations set forth in the Waste Free Ontario Act.

Pursuant to subsection 6.1(1) of the Environmental Assessment Act, any environmental assessment for the above-noted undertaking, submitted to the Ministry of the Environment and Climate Change pursuant to subsection 6.2(1) of the Environmental Assessment Act, must be prepared in accordance with the amended Terms of Reference as hereby approved.

Reasons

I am satisfied that an environmental assessment prepared in accordance with the Terms of Reference will be consistent with the purpose of the Environmental Assessment Act and the public interest for the following reasons:

  1. The amended Terms of Reference ensures that the environmental assessment will be completed using a comprehensive public, Aboriginal and government agency consultation process that is open and transparent.
  2. The amended Terms of Reference ensures that the completed environmental assessment will contain a sufficient level of detail to accurately assess the environmental effects of all alternatives and the proposed undertaking.
  3. The amended Terms of Reference sets out a planning process that will ensure the completed environmental assessment will be consistent with the purpose of the Environmental Assessment Act and the public interest.
